ipnews shall not be liable for damages, delays in performance or failure to perform due to acts or events beyond our or your reasonable control, including but not limited to: fire, lightning, explosion, power surge or failure, flood, natural disasters, war, revolution, civil unrest, or acts of civil or military authority, public enemies; any law, order, regulation, ordinance or requirement issued by or on behalf of any government or legal body; or labor unrest, including but not limited to strikes, slowdowns, pickets or boycotts; inability to obtain raw materials, transportation facilities, fuel or energy shortages, or acts or omissions of other common carriers.
Other Terms
These Terms, together with our Privacy Policy, constitute the entire agreement between the parties to this website. No party other than ipnews has the right to modify these Terms. If any part of these Terms is held to be illegal, invalid or unenforceable, that part will be deemed to be severed from these Terms and will not affect the validity and enforceability of the remaining provisions. IPnews' failure to exercise or enforce any right or provision under these Terms does not constitute a waiver of that right or provision. Any waiver of any right or provision by IPnews must be in writing and will only apply to the specific circumstances specified in the writing. You may not assign these Terms or any rights or licenses granted by these Terms, whether voluntarily, by operation of law or otherwise, without our prior written consent. These Terms shall be governed by the laws of each country, without regard to conflict of laws principles. If these Terms conflict with the laws of each country, the laws of that country shall prevail. In such event, the relevant content shall be modified or reinterpreted in accordance with the law, but without affecting the validity of the rest of these Terms. Any dispute arising out of or related to these Terms shall be submitted to the International Economic and Trade Arbitration Commission ("IETAC") for arbitration in accordance with its rules then in effect. The arbitration language shall be English and the arbitration tribunal shall consist of three arbitrators. The arbitration award shall be final and binding on both parties.

This Acceptable Use Policy, together with the Terms of Service, Data Services Agreement, OEM Agreement, Dealer Agreement, Master Service Agreement, Acceptable Use Policy (AUP), Privacy Policy and the original service quote (collectively, the "Legal Terms"), constitute the entire agreement between the customer and ipnews regarding the services provided, and supersede all prior communications and agreements between the parties regarding the subject matter of the services. This AUP applies to ipnews customers and all users who access the services through customer accounts (collectively, the "Users").
If you do not agree to these legal terms, please do not use our services. Your continued use of our services indicates that you accept these legal terms. Please read this policy carefully. It applies to:
(a) anyone who uses our Services (as defined in the Legal Terms);
(b) access to and users of forms, materials, consent tools, comments, postings and all other content (collectively, “Content”) available on our Services;
(c) Contributors to our Services, including any suggestions, ideas, or proposals for modifications or improvements to the Services (collectively, "Feedback").
The Services must be used in a manner consistent with the intended use of the Services and the terms of the applicable agreement with ipnews . By using the Services, users agree to be bound by the terms of this AUP. When you use the Services, you warrant that you will comply with this policy and all applicable laws.
Prohibited Conduct
1. General Purpose
You promise to use the Service only for lawful purposes and not in violation of any applicable laws and regulations. Your use of the Service should not cause any adverse effects on the Service, other users, or ipnews. In addition, you agree not to use the Service in any manner that may cause ipnews to bear criminal or civil liability. Specifically, this includes but is not limited to not transmitting, distributing, or storing materials that infringe any third party's intellectual property rights, privacy rights, or publicity rights. At the same time, you may not assist others in violating this policy or any applicable third-party policy.
2. Inappropriate Content
It is strictly prohibited to use this service to transmit, distribute or store any material that ipnews deems inappropriate. Such inappropriate material includes, but is not limited to, content that is obscene, indecent, defamatory, libellous, infringing, threatening, abusive, hateful or excessively violent. Also, material that advocates violence against humans or incites hate crimes based on factors such as religion, race or country of origin is strictly prohibited.
3. Intellectual Property
Materials accessed through the Service may be protected by intellectual property laws, including copyright, trademark, trade secret or other proprietary rights. You agree not to use the Service in any way that infringes those rights.
4. Harmful Content
You are prohibited from using the Service to transmit, distribute or store any content that could damage or interfere with the Service, or any third-party network, system, service or website. This includes but is not limited to viruses, worms, Trojan horses and other malware.
5. Fraudulent/Misleading Content
You may not use the Service to transmit or distribute fraudulent or misleading content. You are strictly prohibited from using the Service to send unsolicited emails (i.e., spam) or to send emails with forged sender information. In addition, you may not send malicious emails or use the services of other providers to send spam to promote websites hosted by the Service. You may not continue to send emails to recipients who have explicitly requested to stop receiving emails, use email boxes for the sole purpose of data storage, or engage in any other activity that violates common email etiquette.
7. Inappropriate behavior
Your use of this service should not hinder others from using this service normally. Specific actions include:
a. harass other users;
b. evade payment of fees related to the Service;
c. access a terminated account;
d. engage in phishing activities;
e. Interfere with others' normal access to the Internet;
f. disparage, tarnish or otherwise damage ipnews and/or the Service (as determined by us in our reasonable discretion);
g. upload or transmit content that is disruptive to the Service, such as excessive use of capital letters;
h. Sending spam (continuous posting of repetitive text);
i. upload or transmit material that acts as a passive or active information collection or transmission mechanism (for example, clear GIFs, web bugs, cookies, etc.);
j. Use automated systems to gain unauthorized access to the Service (e.g., spiders, robots, crawlers, etc.).
8. Illegal Use
The Service may not be used for any illegal activity, including but not limited to making death threats, terrorist threats, threats to harm others, conducting multi-level marketing schemes, operating a Ponzi scheme, invading another person's privacy, committing credit card fraud, extortion, libel, slander, dissemination of child pornography, or violating the Child Protection Act of 1984.
9. Security
You may not violate or attempt to violate the security of the Service, or any third-party computer, account or network. Specific actions include circumventing user authentication or security measures, causing security vulnerabilities or Internet communication interruptions, and failing to update software security patches in a timely manner.
10. Sharing and Modifying the Service
You may not share the Service, or any data obtained through the Service, with any unauthorized third party. This includes all forms of distribution, such as reselling, disclosing, publishing, or delivering the Service or related data. You may also not modify the Service in any way, including copying, creating derivative works, or incorporating related data into your own products or services. In addition, you may not attempt to reverse engineer, disassemble, or otherwise explore the underlying code or methods used to compile the data. Finally, you must refrain from removing any proprietary notices contained in the Service.
Reporting Violations of This Policy
ipnews is not obliged to review or audit content or feedback generated by users on the Service. We are not responsible for any loss or damage caused by users' violation of this policy. If you believe that certain content or feedback violates this policy, you can report the violation to us in detail at support@ipinfo.io.
Consequences of Violating This Policy
If you violate this policy, you may be unable to access the Service. If you continue to fail to comply with this Acceptable Use Policy after receiving a warning, ipnews has the right to terminate the agreement with you and completely prohibit you from accessing the Service. In addition, if we suspect a violation, we may cancel the agreement directly even without prior warning.
Disclaimer
ipnews does not monitor user activity and is not responsible for abuse of the service. We are also not responsible for any user-generated content or feedback. However, if we find content or feedback that violates this policy, we may remove it, block your account, and report the violation to the relevant authorities. This policy only applies to users who have signed an agreement with our service.
